Terms & Conditions

These Terms & Conditions (the “Terms”) govern your access to and use of the Franchise Hunt website at www.franchisehunt.co.uk and any related services (together, the “Service”). Please read them carefully. By using the Service you agree to these Terms; if you do not agree, please do not use the Service.

1. Who we are

The Service is operated by Franchise Hunt Ltd, a company registered in England and Wales under company number 14675349, with its registered office at 124 City Road, London, England, EC1V 2NX (“Franchise Hunt”, “we”, “us” or “our”). You can contact us at [email protected].

2. What Franchise Hunt is, and is not

Franchise Hunt is an online directory and introduction service. We list franchise opportunities and, where you ask us to, pass your enquiry to the relevant franchisor so they can contact you directly.

We are not a franchisor and we do not sell, offer or operate any franchise ourselves. We are not a party to any agreement you enter into with a franchisor, and we do not act as your agent or adviser. Any franchise you pursue is a matter solely between you and the franchisor concerned.

3. No professional advice, do your own due diligence

The information on the Service, including listings, costs, earnings figures and guides, is provided for general information only. It is not financial, legal, tax or investment advice and must not be relied on as such.

Buying a franchise is a significant financial commitment. Before entering into any franchise agreement you should carry out your own due diligence and take independent professional advice (for example from a solicitor, accountant or franchise consultant). We do not guarantee the accuracy, completeness or current availability of any listing or figure, much of which is supplied by franchisors themselves.

4. Eligibility and accounts

You must be at least 18 years old to use the Service. If you create an account, you agree to provide accurate information, to keep your login details confidential, and to be responsible for all activity under your account. Notify us promptly if you believe your account has been compromised.

5. Enquiries and introductions

When you submit an enquiry or request to be contacted about a franchise, you authorise us to share the details you provide (such as your name, contact details, location and investment level) with the relevant franchisor(s) so they can respond to you.

Each franchisor decides independently whether and how to contact you and is responsible for its own communications and conduct. We are not responsible for the products, services, representations or behaviour of any franchisor. How we handle your personal data is explained in our Privacy Policy.

6. Acceptable use

You agree not to misuse the Service. In particular, you must not:

  • use the Service for any unlawful, fraudulent or misleading purpose;
  • submit false, inaccurate or third-party information without authority;
  • attempt to gain unauthorised access to the Service, other accounts, or our systems;
  • scrape, harvest, copy or republish listings or other content except as permitted by these Terms;
  • introduce malware or otherwise interfere with the operation, security or integrity of the Service;
  • use the Service to send spam or unsolicited marketing.

7. Franchisor and partner content

If you are a franchisor or partner and submit a listing or content to us, you confirm that you have the right to do so and that the content is accurate, lawful and not misleading. You grant us a non-exclusive licence to host, display and promote that content on the Service. We may review, edit, decline or remove any submission at our discretion.

8. Intellectual property

The Service, including its design, text, graphics and software (but excluding franchisor-supplied logos and content), is owned by or licensed to Franchise Hunt and is protected by intellectual property laws. You may view and use the Service for your own non-commercial purposes. You may not copy, reproduce, distribute or create derivative works from the Service without our prior written consent.

9. Third-party links

The Service may contain links to third-party websites. We provide these for convenience only and do not control or endorse them, and we are not responsible for their content, products or privacy practices.

10. Disclaimers and limitation of liability

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we exclude all warranties, conditions and representations not expressly set out in these Terms.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under English law.

The Service is a directory: any dealing, agreement or transaction you enter into with a franchisor or other third party is solely between you and them, and we are not a party to it. We do not endorse, and are not responsible for, the content, accuracy or availability of any third-party website, listing or information accessed through the Service.

Subject to the paragraph above on liability we cannot exclude, we are not liable for any loss arising from your dealings with any franchisor or third party, for any business, profit, revenue, goodwill or anticipated savings, or for any indirect or consequential loss.

Our total liability to you in connection with the Service, whether in contract, tort (including negligence) or otherwise, is in all cases limited to the greater of (a) the total amount you have paid us for the Service in the 12 months before the claim arose, or (b) £100.

11. Indemnity

You agree to indemnify us against any losses, liabilities, costs and expenses we reasonably incur arising from your breach of these Terms or your misuse of the Service.

12. Suspension and termination

We may suspend, restrict or terminate your access to the Service (including any account) at any time if you breach these Terms or if we reasonably consider it necessary. You may stop using the Service and close your account at any time.

13. Changes

We may change the Service or these Terms from time to time. Where changes are material we will take reasonable steps to bring them to your attention. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing law and jurisdiction

These Terms and any dispute arising out of or in connection with them are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.

15. General

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force, and the invalid provision is to be applied to the greatest extent permitted by law. Our failure to enforce any right or provision is not a waiver of it.

These Terms (together with our Privacy Policy and Cookies Policy) are the entire agreement between you and us regarding the Service. We may transfer our rights and obligations under these Terms to another organisation; you may not transfer yours without our consent. These Terms do not create any rights enforceable by anyone who is not a party to them under the Contracts (Rights of Third Parties) Act 1999.
